1. Valid Certificate of Sponsorship (CoS)

Important Rules for Care Workers & Senior Care Workers (SOC 6135 & 6136)

1. Mandatory CQC Regulation

In England, sponsors recruiting under SOC codes 6135 (Care Workers and Home Carers) and 6136 (Senior Care Workers) must be actively registered with the Care Quality Commission (CQC) and carrying out a regulated activity.

  • Transitional Allowance: Care workers already sponsored prior to 11 March 2024 by an employer that was not CQC-registered may extend their permission with the same sponsor. However, moving to a new sponsor requires the new employer to be CQC-registered.

2. Prohibition on Family Dependants

Sponsorship under SOC codes 6135 and 6136 is strictly restricted to the primary worker. Main applicants applying in these two roles are prohibited from bringing family dependants (partners or children) to the UK.

  • Transitional Protections: This restriction does not apply to care workers or senior care workers who applied for their original Skilled Worker / Health and Care visa prior to 11 March 2024 and have continuously held permission in the route since then, nor does it prevent children born in the UK from being registered as dependants.

3. In-Country Switching Requirement
